Organiser & Eligibility
- This NESCAFÉ CHILL LAH GIG Contest [“Contest”] is organised by Nestlé Products Sdn. Bhd. [45229-H] [“the Organiser”] and is open to all Malaysian residents with a valid MyKad aged 18 years and above as of 12th July 2010.
- The following group of persons shall not be eligible to participate in this Contest:
- Employees of the Organiser [including its affiliated and related companies] and their immediate family members [children, parents, brothers and sisters, including spouses]; and/or
- Representatives, employees, servants and/or agents of advertising and/or promotion service providers of the Organiser [including its affiliated and related companies], and their immediate family members [children, parents, brothers and sisters, including spouses].
Duration
- This Contest will run from 12th July 2010 at “00:00:01” to 25th November 2010 at “23:59:59” [“the Contest Period”]. The Organiser reserves the right to amend the Contest Period at any time. All entries received outside the Contest Period will be disqualified.
Submission of Entries & Qualifying Criteria
- To participate in this Contest, the participants must be registered as a member at www.nescafe.com.my/chilllah website ["Website"] or via Facebook Application at http://apps.facebook.com/chilllah ["Facebook Apps"]. Please refer to the NESCAFÉ Website and Facebook Apps privacy policy and the terms and conditions which will bind the members and users of the NESCAFÉ Website and the Facebook Apps.
- Each participant may only have one [1] Website member account at www.nescafe.com.my/chilllah. Registration is only open to Malaysian residents with a valid NRIC and email address.
- No proof of purchase is required for participation in this Contest. Each participant is entitled to submit more than One [1] entry.
- There are three [3] stages to this Contest, as follows :-
Stage 1 - Submission of Jingle
- To participate in this Contest, participants are required to log on to the Facebook Apps and select one of the three [3] preset melodies [“Melody”], enhance the Melody by using the NESCAFÉ Chillah GIG tool to form a jingle [“Jingle”], submit a title [“Title”] and lyric [“Lyric”] for the Jingle, complete the registration form with the required details like Name, IC, Email and Contact Number and agree to the Contest Rules and Regulations herein and Nestlé Privacy and Policy.
- The Title and Lyric must be written in English, Bahasa Malaysia or Mandarin only. Participants must include the Title in not more than five [5] words and the Lyric must be written with a maximum of One Hundred [100] words. All submitted lyrics MUST contain the words NESCAFÉ Chill-lah and HOMONYMS. [Homonyms are two words that sound alike but have different meanings and that can be spelled the same or differently [e.g. trunk (meaning: part of an elephant) and trunk (meaning: a storage chest) or days (meaning: more than one day) and daze (meaning: to bewilder)].
- Each entry received during the Contest Period will be serialized according to the time of receipt (yy/mm/dd/hh/mm/ss/). In the event of duplicate entries from the same participant, the submitted entry which is most recent will be treated as a valid entry. In the event of duplicate submissions from different participants, the first submitted entry will be treated as a valid entry based on the time of receipt.
- All Jingle submissions must be received by the Organiser by 23:59:59 of 12th Sep 2010. Submissions after this date will be automatically disqualified.
- In order to participate in this Contest, each entry submitted must complete all the steps in the Contest. Any incomplete or incorrect entries will be automatically disqualified. Each participant may submit more than one [1] entry.
- Participants who have successfully submitted their entries via the Facebook Apps will be notified via email.
- The panel of judges will select fifty (50) entries to qualify to Stage 2 ["Selected 50"] of the Contest. The judging criteria of the entries will be based on completeness, creativity, originality and relevancy of the Lyric and Title to the Contest.
- Only the participants of the Selected 50 will be notified via email and/or telephone and will then be given details for Stage 2 of the Contest. The Organiser will not be held responsible should there be any error, delay or defect in notification via the email and/or telephone to the participants of the Selected 50. Please refer to the Liability & Responsibility section in this Website which will bind the members and users of this Website.
Stage 2 - Submission of Music Video
- All participants of the Selected 50 must produce a music video with a maximum duration of One [1] minute.
- All submitted music video MUST feature the original Jingle, Lyric and Title from Stage 1, any/all of the NESCAFÉ coffee canned drinks, voice to sing the Jingle either in solo or group and a subtitle of the Lyric. Lyric must be included in English, Bahasa Malaysia or Mandarin only. Any incomplete submissions and/or music video with amended Jingle, Lyric and Title will be automatically disqualified.
- All music videos will be accepted as long as it complies with the Rules & Regulations herein and it does not breach any Intellectual Property laws, including but not limited to copyright laws. Submission that breaches the Rules & Regulations herein and/or any Intellectual Property laws will be automatically disqualified.
- All participants of the Selected 50 may not be the singer in the music video. Participants who get their friends and/or family members to sing or featured in the music video must first obtain permission from the respective friends and/or family members.
- The music video is to be delivered in a compact disc ["CD"] or a digital video disc ["DVD"] rom to NESCAFÉ CHILL LAH GIG CONTEST, c/o MediaConcise Sdn. Bhd., L-5-10, No 2, Jalan Solaris, Solaris Mont Kiara, 50480, Kuala Lumpur. The final submission deadline for the video clip is 23:59:59, 21st October 2010.
- Submissions received after the deadline will be automatically disqualified. All participants with complete submissions will qualify for the final stage, Stage 3 [“Finalists”].
Stage 3 - Voting for music videos
- All music videos from Stage 2 will be published on the NESCAFÉ Website for public feedback, comments, viewing and voting, starting from 00:00:01, 05th November 2010 and ending 23:59:59, 25th November 2010 ["Voting Period"].
- During the Voting Period, NESCAFÉ members are allowed to cast only One [1] vote per day for any one of the music videos on the Website. Only votes received during the Voting Period will be considered as valid votes.
- The voting by members will constitute 50% of the total votes while the remaining 50% will be based on the judging by the selected panel of judges. The judging criteria of the submitted music video will be based on completeness, creativity, originality and relevancy of the music video to the Contest.
- Based on the votes by members and judges, there will be ONE grand prize, followed by 1st and 2nd prizes This will be judged based on the finalists that have the highest number of votes.
Refer Friends Incentive Category
- There is also a Refer Friends Incentive Category that encourages participants to invite as many friends through the Website ["Viral Email"]. Once the participant's friends have received the Viral Email, they must OPEN, READ and CLICK on the URL in the viral email AND REGISTER as a NESCAFÉ website member. One [1] point will be awarded to the referrer for each new Website registrant.
- The URL in the viral email [e-blast] can only be clicked Once [1] and will be counted as an entry as per their email addresses. Should the friends receive the Viral Email the second time, the second click will NOT be counted as an entry.
- Only the top Five [5] referrers with the highest points will qualify for the Refer Friends Incentive Prizes.
Voters' Incentive Category
- There is a Voters' Incentive Category to encourage participation from NESCAFÉ website members and rewards registered voters for their interest in the Contest.
- All NESCAFÉ website members are eligible to vote and in order to win the Voters' Incentive Category the NESCAFÉ website member have to vote for their favourite music video in Stage 3 and complete the slogan - "I voted for this music video because…" in not more than 25 words [“Slogan”].
- All voters are only permitted to cast one vote per day during the Voting Periods throughout the Contest Period
- Only voters who voted for the Grand Prize, 1st and 2nd Prizes will qualify for the Voters' Incentive Prize. From this qualified Voters list, only five [5] best slogans will win the Incentive Prize.
- The judging of the submitted slogans will be based on completeness, creativity, originality and relevancy of the slogans.
Prizes
- The Prizes for this Contest consist of three [3] categories.
- Category 1: Participants Category
- Stage 2 - Participants of the Selected 50
- All participants of the Selected 50 who submit their music videos with the original Jingle and Lyric will be entitled to a reward prize of Ringgit Malaysia Two Hundred [RM200.00] each.
- Thirty [30] participants of the Selected 50 who first submit their music videos with the original Jingle and Lyric will each receive one [1] additional Early-bird prize:-
- 100 music-download credits worth Ringgit Malaysia Five Hundred [RM500] only.
- Stage 3 – Contest Winners
- Three [3] winners will be selected from the fifty [50] Finalists in Stage 3. Finalists with the highest votes will each receive these following prizes:-
- Grand Prize – The Finalist with the highest number of votes will be the Grand Prize winner and will receive Ringgit Malaysia Ten Thousand [RM10,000.00].
- 1st Prize – The Finalist with the second highest number of votes will be the First Prize Winner and will receive Ringgit Malaysia Two Thousand [RM2,000.00].
- 2nd Prize – The Finalist with the third highest number of votes will be the Second Prize winner and will receive Ringgit Malaysia One Thousand [RM1,000.00].
- Category 2: Refer Friends Incentive Category
- Five [5] referrers will be selected based on the most Viral Email sent to friends who OPEN, READ and CLICK on the URL in the viral email and REGISTER as a Website member and each will receive one [1]:-
- Ringgit Malaysia One Hundred [RM100] only and
- 100 music-download credits worth Ringgit Malaysia Five Hundred [RM500] only.
- Category 3: Voters Incentive Category
- Five [5] voters will be selected based on the most creative slogans and will each receive one [1]:
- Ringgit Malaysia One Hundred [RM100] only and
- 100 music-download credits worth Ringgit Malaysia Five Hundred [RM500] only.
Prizes Redemption
- Winners' names will be announced on the Website and will be notified via Email and/or Telephone through their contact details provided to the Organiser when they register as a NESCAFÉ Website member. The Organiser will not be held liable in the event the winner(s) cannot be contacted for whatever reasons after at least three [3] attempts by the Organiser or its agents to contact the winners. All prizes must be claimed within three [3] months from the date of notification. All unclaimed prizes will be forfeited. The Organiser will not be held liable in the event of non-receipt or delayed delivery of the postal notification to the winner[s].
- Each participant can only win one [1] prize throughout the whole Contest period. In the event that a participant wins two [2] prizes in the same category, the participant automatically wins the higher valued prize. The lower valued prize will be won by the next highest qualified entry received from the same Category.
- The Organiser shall reserve the right at its absolute discretion to substitute any of the prizes with that of similar value, at any time without prior notice. The values of the prizes are correct at the time of printing. All prizes are given on an “as is” basis and are not exchangeable for cash, credit, other items or voucher, in part or in full.
- All winners must abide by the terms and conditions of the parties arranging and/or providing for the prizes and the terms and conditions attached to the prizes, if any.
Liability & Responsibility
- Winners shall assume full liability and responsibility in case of any liability, mishap, injury, damage, claim or accidents [including death] resulting from their participation in this Contest, redemption and/or utilisation of the prizes. The Organiser shall not be responsible for any liability, mishap, loss, damage, claim or accident (including death) in any manner whatsoever.
- All recording, transportation, accommodation, personal costs and/or any other costs, fees and/or other expenses that are incurred to participate in this Contest and to redeem the prize is the sole responsibility of the winner.
- The Organiser is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of, user or member communications, or any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet and/or Websites.
- The NESCAFÉ Website is provided on an “as is” basis and, except as otherwise prohibited by applicable law, the Organiser expressly disclaim any warranty of any kind, including, but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The Organiser cannot guarantee and do not promise any specific results from use of the NESCAFÉ Website. No advice or information, whether oral or written, obtained by you from us, or from or through the NESCAFÉ Website shall create any warranty not expressly stated herein.
Rights of the Organiser
- By submitting your materials for this Contest, all participants agree and acknowledge that all intellectual property rights thereto shall belong to the Organiser. The Organiser shall have the exclusive right to use, edit, modify and publish all lyrics, jingles, scripts, slogans and music videos submitted by all the participants, publish the names, lyrics, jingles, scripts, slogans and music videos of the participants, in any way it deems fit for any advertising, trade, promotional purpose and for any other reason whatsoever, without any further notice to the participants and the participants shall not claim ownership or any payment or compensation on the materials. For the avoidance of doubt, the submissions will not be edited for judging purposes.
- The Organiser reserves the right to modify, suspend or cancel this Contest in the event that it becomes not capable of running as planned, technically interfered or corrupted, including but not limited to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of the Organiser, despite the best efforts of the Organiser.
- The Organiser reserves the right, in its sole discretion, to disqualify any participant that is found or suspected of tampering with the Contest submission process, the operation of this Contest or to be in violation of the Conditions of Access of the NESCAFÉ Website. The Organiser reserves the right to terminate the NESCAFÉ Website member account of any person who it reasonably suspects has violated or infringed any of these general terms and conditions and the Organiser reserves the right to pursue legal action against any individual it believes has undertaken fraudulent activities or other activities harmful to this online Contest, the Contest submission process and/or the NESCAFÉ Website.
- Participants also agree that the Organiser is not responsible nor liable for any delay, injury or damage to the participant’s and/or any third party's computer, computer system or apparatus relating to or resulting from the access to, participation in this Contest, including the playing, downloading of any materials or information from the NESCAFÉ Website and in connection with this Contest, submission/uploading for this Contest, including without limitation any server failure, lost, delayed or corrupted data or other malfunction.
Other Terms & Conditions
- All Jingles, Titles, Lyrics, Slogans and Music Videos submitted must be original and shall not breach any intellectual property rights belonging to any party. The participants shall not pose, distribute, reproduce or submit in any way whatsoever, any lyrics, jingle, slogans, titles and music videos containing any other party’s intellectual property rights, including but not limited to copyrights, or other proprietary information owned by another party without obtaining the prior written consent of the owner of such intellectual property rights or proprietary information. If you believe that your work has been copied and posted in a way that constitutes an intellectual property infringement, please contact the Organiser.
- The Organiser, in its sole discretion, reserves the right to modify this Rules & Regulations without any prior notice, if required for the smooth running of the Contest.
- This Rules & Regulations are prepared in English only.
- The Judges’ decisions are final and no correspondence thereon will be entertained.
- By participating in this Contest, participants agree to be bound by this Contest Rules & Regulations, and the decisions of the Organiser.
Technical Requirements
- All Videos to be submitted/loaded on the Website must comply with the following specifications:
- Minimum video resolution : 320 X 240 pixels
- Maximum video resolution: 640 x 480 pixels
- Maximum video length: 1 min
- Format allowed: MPEG, AVI, FLV, WMV, QUICKTIME or 3GP
Submissions that do not adhere to these requirements will be automatically disqualified. An email notification of disqualified entries will be sent out to the participants.
- The Organiser shall not be held liable or responsible for any delay and/or failure in the receipt of entry due to the inability of the respective Internet Service Provider [ISP] company and/or telecommunication network to provide timely and/or efficient internet and/or telecommunication services.
- Participants also agree that the Organiser is not responsible nor liable for any delay, injury or damage to the participant's and/or any third party's computer, computer system or apparatus relating to or resulting from the access to, participation in this Contest, including the playing, downloading of any materials or information from the web-site and in connection with this Contest, submission/uploading of the photographs for this Contest, including without limitation any server failure, lost, delayed or corrupted data or other malfunction.
- The web-site is provided on an "as is" basis and, except as otherwise prohibited by applicable law, the Organiser expressly disclaim any warranty of any kind, including, but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. The Organiser cannot guarantee and does not promise any specific results from use of www.nescafe.com.my. No advice or information, whether oral or written, obtained by you from us, or through www.nescafe.com.my shall create any warranty not expressly stated herein.
Prohibited Content
- Below is a partial list of content that is illegal or prohibited to be posted on the Website. Posting of any of this content by the participant may, in the Organiser's sole discretion, result in termination of membership in addition to the disqualification of participation. In addition, the Organiser reserves the right to investigate and take appropriate legal action, in its sole discretion, against anyone who violates this provision, including without limitation, removing the offending communication from the NESCAFÉ Website and/or Facebook Apps and reporting such violators to the appropriate legal authorities. Prohibited content includes, but is not limited to, contents which, in the Organiser's sole judgment:-
- is offensive to the online community, such as content that promotes racism, politically religious agendas, inflammatory religious content, violence, foul language, bigotry, hatred or physical harm of any kind against any group or individual;
- include ingredients that are offensive to other religious practices and/or NESTLÉ competitive products that appear in the music video;
- harasses or advocates harassment of another person;
- involves the transmission of "junk mail", "chain letters," "spam," or any other unsolicited mass mailing, e-mailing, or other communication;
- includes any information that [1] the participant knows is false or misleading, [2] promotes illegal activities or conduct that is abusive, or [3] is threatening, obscene, defamatory, or libelous;
- constitutes or includes any illegal or unauthorized copy of another person's copyrighted or copyrightable work, including, but not limited to, [1] pirated computer programs or links to them, [2] information which circumvents manufacturer-installed copy-protect devices, [3] pirated music or links to pirated music files;
- displays obscene, pornographic or sexually explicit material of any kind;
- includes material that exploits people in a sexual or violent manner;
- provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses.
